By accessing or using digittwin ("Service," "Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

Eligibility

To use digittwin, you must:

digittwin offers various subscription plans:

• Pro Plan: AI workout generation, analytics, and goal intelligence
• Elite Plan: Advanced features, priority support, and custom training programs

Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Payments are processed securely through our payment provider (Polar.sh)
• You authorize us to charge your payment method automatically each billing period
• Prices are subject to change with 30 days' notice

Cancellation and Refunds

• You may cancel your subscription at any time through your account settings
• Cancellations take effect at the end of the current billing period
• No partial refunds are provided for unused portions of a subscription period
• We may offer refunds at our discretion for special circumstances

Acceptable Use

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Transmit any viruses, malware, or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Scrape, copy, or duplicate content without permission
• Impersonate others or misrepresent your affiliation
• Harass, abuse, or harm other users
• Share your account credentials with others

Nature of Service & Health Disclaimer

By using our Service:

• You acknowledge that you are using the Service at your own risk
• You understand that AI-generated workouts are suggestions, not medical advice
• You agree to consult with a doctor before beginning any exercise program
• You will stop exercising and seek medical attention if you experience pain, dizziness, or discomfort
• You understand that results may vary and are not guaranteed

AI-Generated Content

digittwin uses artificial intelligence to generate personalized workout plans and provide fitness coaching:

• AI-generated workouts are based on general fitness principles and your input
• The AI may make mistakes or provide suggestions that are not suitable for you
• You are responsible for evaluating whether AI suggestions are appropriate for your fitness level and health condition
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content
• Always use your own judgment and consult with professionals when needed

Intellectual Property

Our Content

The Service and its original content, features, and functionality are owned by digittwin and are protected by:

• Copyright, trademark, patent, and trade secret laws
• International copyright conventions
• Other proprietary rights and laws

Your Content

You retain ownership of your workout data, progress photos, and other content you create. By using the Service, you grant us:

• A non-exclusive, worldwide license to use your content to provide the Service
• Permission to use anonymized and aggregated data to improve our AI and analytics
• The right to display your content within the Service (e.g., on your profile)

We will not share your personal workout data publicly without your explicit consent.

Third-Party Services

digittwin integrates with third-party services:

• Clerk (authentication)
• Polar.sh (payments)
• XAI/Grok (AI features)
• Pinecone (personalization)

Your use of third-party services is subject to their own terms and privacy policies. We are not responsible for the practices of these third parties.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• digittwin and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• This includes damages for loss of profits, data, use, goodwill, or other intangible losses
• Our total liability shall not exceed the amount you paid to us in the 12 months before the claim
• We do not warrant that the Service will be uninterrupted, secure, or error-free
• We are not liable for any injuries, health issues, or damages resulting from your use of the Service

Indemnification

You agree to indemnify, defend, and hold harmless digittwin, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your content or conduct on the Service

Dispute Resolution

Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if they qualify.

Class Action Waiver

You agree that disputes will be resolved individually, not as a class action, and you waive your right to participate in a class action lawsuit.

Termination

We may terminate or suspend your account and access to the Service:

• Immediately, without prior notice, for any breach of these Terms
• For any reason, with 30 days' notice
• If required by law or legal process

Upon termination, your right to use the Service will cease immediately. You may export your data before termination.

Changes to Terms

Your continued use of the Service after changes constitutes acceptance of the new Terms.

Severability

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and digittwin regarding the Service and supersede all prior agreements.
